Mediation vs. Arbitration

Although both involve a third-party presence, mediation and arbitration are entirely different processes. An arbitrator listens to each party’s claim. Next step is making a decision using their judgment of the facts. A mediator, however, does not use their judgment when dealing with a case. Instead, they help the two parties communicate! They guide them towards an agreement rather than deciding on one for them. A mediator helps keep things civil while staying true to the law.

When to Use a Mediator

Mediators can typically be brought in with most civil cases. Most courts will judge the initial information of civil cases. They may also recommend mediation if they believe reconciliation is possible. Mediation saves the time and money a lawsuit would cost while still helping you find an agreement on your case. Although it’s less formal than a court hearing. Mediation still provides a legally enforceable outcome. Therefore, your decision will still be considered as final as if it was held in a courtroom.

When Not to Use a Mediator

A mediator is a great option for two parties that are on equal footing that need a little help. However, many civil law cases don’t always have an equal balance. If the other party is abusive, making threats, or has a lawyer where you don’t, mediation may not be the best option. You’ll likely want a court hearing instead where you can feel safer saying what you need to say. You have ten days from the referral for mediation to file a written request for a hearing.

What to Expect in a Mediation

The job of the mediator is not to pass judgment or make a decision for you. Instead, a mediator will listen to both sides of the story and help you come to an agreement. Before going into mediation, speak with your lawyer about what happened! Tell your lawyer what goals you have, and what you are or are not willing to compromise on. The mediator will never reveal what you have discussed with them and won’t reveal to you what they discussed with the other party. Be sure to bring all documents you may have!  That will provide evidence for your case and detail what you want to get out of the mediation.

After discussing the case with both parties, the mediator will then bring everyone together and facilitate communication. The mediator’s job is not to provide a solution but help the two parties reach a solution they both can agree on. A mediator may offer some suggestions, but any suggestion is not set in stone unless agreed upon and signed off on by both parties.
