Truck Laws

Texas law defines a truck as any motor vehicle used primarily to transport items or property, and as such, truck drivers must follow the same rules of the road as other motorists. However, because trucks are designed for longer travel with varying contents, they also must adhere to additional laws.

While on duty, a property-carrying truck driver is only allowed to operate a maximum of 14 hours consecutively, which must be followed by ten consecutive off-duty hours. During that 14-hour period, a driver is only allowed to operate the truck for 11 hours. However, a truck driver cannot operate more than 60 hours on-duty in any consecutive seven-day period. Many truck accidents are caused by fatigue of the driver, and going over these maximum working hours puts everyone on the road at additional risk.

Causes of Truck Accidents

Although fatigue is the top cause, many other factors can play into a truck driving accident. Regular laws of the road still apply, and truck drivers can still be at fault for breaking them. A truck driver can cause an accident by:

– Speeding
– Ignoring traffic regulations
– Driving under the influence
– Becoming distracted (such as by texting or talking on the phone)

Trucks and drivers are also responsible for additional safety measures when operating. Trucks and their drivers can cause an accident by:

  • Being improperly loaded with cargo
Not being adequately trained and licensed to drive
    Not being properly inspected
    Not being properly maintained

While truck drivers need to follow the rules of the road like all motorists, truck companies and manufacturers need to follow rules and regulations when assembling and loading trucks for use.

Fault

When you submit a personal injury claim for a truck accident, you need to know who you are suing. There are four different parties you could sue, depending on what caused the accident.

Truck Driver

If the truck driver was not following the rules of the road, their negligence could cause an accident. In this case, the driver is at fault and becomes liable for the injuries and damages sustained.

Truck Company

It is the job of the truck company to ensure all their trucks and drivers are fit for duty. If a driver was not properly licensed, not adequately trained, or was required to operate for more than their allotted hours, the truck company could be at fault for the accident. By not adhering to federal regulations, the company puts others at risk and becomes liable for the injuries and damages the accident caused.

Cargo Company

It’s important for a truck carrying cargo to be properly loaded. If too much weight is placed on any one side, the truck can become unbalanced and lose control. When cargo is not properly secured, it could come loose on the road and cause unnecessary dangers. If a truck accident was caused by improper loading of cargo, it becomes the responsibility of the cargo company to compensate for injuries and damages.

Truck Manufacturer

Like most vehicles, it’s possible for trucks to have faulty parts or be improperly designed. If any part of the truck fails to work as intended, it can cause a variety of accidents to occur. In this instance, the manufacturer of the faulty component becomes liable for the accident.

It could be the case that both you and the truck or driver were at fault for an accident. If this is true, you could still receive compensation. Texas law follows the modified comparative fault guidelines, meaning the compensation you receive is related to what percentage you were at fault. As long as you were under 50% responsible for the accident, you can still receive partial compensation for your injuries and property damages.

Being involved in a truck accident is scary, and dealing with the aftermath is stressful. With a qualified and experienced truck accident on your side, you can focus on recovery while they fight to get you the compensation you deserve.
